Archived from the original on 10 December Social Trends Jan 23, The decision of the Constitutional Court in the case of Minister of Home Affairs v Fourie on 1 December extended the common-law definition of marriage to include same-sex spouses—as the Constitution of South Africa guarantees equal protection before the law to all citizens regardless of sexual orientation —and gave Parliament one year to rectify the inequality in the marriage statutes. Marriages and civil partnerships must be solemnised by an authorised marriage officer. Hodges legalized gay marriage nationwide, including in the 14 states that did not previously allow gays and lesbians to wed. Couples marrying in terms of the Civil Union Act may choose whether their union is registered as a marriage or a civil partnership.
